R T Last date extended upto 02-04-2012


Consequent on representation dtd 13-03-’12  by our Unions regarding non-notification of vacancies in various offices by the SPO’s erroneously in connection with Rotational Transfers for 2012-2013, the SPO’s has issued ‘Corrigendum’  on 27-03-’12 regarding the number of vacancies in various offices, thus facilitating the aspirants of Rotational Transfers. Last date is also extended upto 02-04-2012.

        Our union thanks the Divisional Administration for it’s timely response.

ADHOC PROMOTION MADE IN THE CADRE OF HSG-1


1.     Pay & Allied Issues

1.      What are all the conditions for claiming stepping up of Pay with juniors?

Ø  (i) Both senior and junior must be in the same cadre in identical pay scales and also in the same recruiting unit.
(ii) Posts to which they are promoted must also be identical and same.
(iii) At the time of promotion, senior must be getting equal or more pay than junior.
(iv) Anomaly should be direct result of application of FR 22 (c) or any pay fixation rules.

2.      How option can be made for pay fixation on date of promotion which will be advantageous?

Ø  As per the revised pay rules, if the promotion is in between 2nd July to 31st December, his next increment will be from 1st July of the same year. If the promotion is accorded in between 1st Jan to 30th June in a year, his increment will be drawn only in the next year. So, one has to carefully study before making option for pay fixation at the time of promotion.

3.      What is the restriction under FR 35 for officiating pay when a Government is ordered to work in higher posts?

Ø  As per DOPT OM No. F/1/4/2009 - Estt (pay I) dt. 08.03.2010, for employees receiving pay in the pay band up to Rs.14880 PM (our cases), 15% of the basic pay subject to a maximum of Rs. 2000/- PM (including the difference of grade pay between the feeder and the promotional post). The annual increment @ 3% of the basic pay so fixed shall be granted.

4.      What are all the cases which will not construe under the pay anomalies?

Ø   (i) Senior getting less pay in lower post due to postponement of date of next increment on account of his proceeding on extraordinary leave.
(ii) Senior refusing promotion leading to early promotion of the junior and later promotion of the senior.
(iii) Junior getting higher pay in lower post due to adhoc arrangements.
(iv) Senior joining higher post later and getting lower pay.
(v)  Senior appointed to lower post later than the junior but getting promoted earlier than the junior.
(vi) Senior direct recruits getting less pay than the junior promotees whose pay is fixed with reference to pay last drawn.
(vii)Junior getting more pay due to additional increments earned on acquiring higher qualifications.

5.      Whether stepping up of pay can be allowed second time with another official?

Ø  As per DOPT order dated 22.07.1985, the benefit of stepping up of pay can be allowed to senior official second time, provided the anomaly has arisen with reference to the pay of the same junior, with reference to whom the pay of the senior was stepped up first time. As such there is no provision to step up with another person directly.

Kind reference is invited to the Ministry of Finance, Department of Expenditure O.M.No.10/02/2011- E.III/A dated 19th March, 2012 wherein all the central government employees who were due to get their annual increment between February to June during 2006 were granted one increment on 1.1.2006 in the pre-revised pay scale as a one time measure and there after next increment in the revised pay structure on 1.7.2006 as per Rule 10 of CCS(RP) Rules, 2008 (Copy enclosed for ready reference).
I wish to submit  that my increment in pre revised pay scale  was on __________ and hence, in terms of the above Office Memorandum, I am eligible for one additional increment in pre-revisedpay scale as a one time measure and also eligible for  next increment in the revised pay structure on 1.7.2006 as per Rule 10 of CCS(RP) Rules, 2008.
In view of above submission,  I request that  one additional increment may kindly be granted and my pay may please be fixed  as stipulated in above O.M. and that the arrears of pay and allowance may kindly be drawn and paid to me at an early date.

New Delhi, Mar 27, 2012(PIB): Section 80E of the Income Tax Act, 1961 provides for a deduction to an assessee (being an individual), out of his income chargeable to tax, on account of any amount paid by him in the previous year by way of interest on loan taken by him from any financial institution or any approved charitable institution for the purpose of pursing his higher education or for the purpose of higher education of his relative.
Section 80E provides tax exemption on interest paid on the education loan.
Under the earlier provisions, the deduction was available only for pursuing full time studies for any graduate or post-graduate course in engineering, medicine, management or for post-graduate course in applied sciences or pure sciences including mathematics and statistics.
The provisions of the aforesaid section 80E were amended vide the Finance (No. 2) Act, 2009 by substitution clause ( c ) of sub-section (3) so as to extend its scope to cover all fields of studies (including vocational studies) pursued after passing the Senior Secondary Examination or its equivalent from any school, board or university recognized by the Central Government or State Government or local authority or by any other authority authorized by the Central Government or State Government or local authority to do so.
The above-mentioned tax incentive can be claimed by an individual depending on the amount he/she spends by way of interest on loan for higher education. There is no fund earmarked for this purpose. The expense to the Government is in the form of revenue forgone on account of such claims during a financial year. The revenue forgone during the year 2010-11 on account of deduction under section 80E, as reported in the Receipts Budget 2012-13, is Rs. 138 crores.
This information was given by the Minister of State for Finance, Shri S.S. Palanimanickam in written reply to a question in the Rajya Sabha today.

Railway Employees to march to Parliament tomorrow


New Delhi, Mar 27, 2012(PTI): Seeking adequate budgetary support and filling up vacant posts in railways, its employees will march to Parliament tomorrow to press their various demands.

“We want government should provide adequate budgetary support to railways because the national transporter is facing a financial crisis and passing through a very critical stage,” said All-India Railwaymen’s Federation (AIRF) general secretary Shiv Gopal Mishra.
Besides, AIRF also wants that the recruitment drive in railways be speeded up to fill about 2.5 lakh vacant posts.
“We have a slew of long pending demands which include removal of anomalies of the Sixth Central Pay Commission, relaxation in duty hours, scrapping of New Pension Scheme, implementation of various welfare schemes announced by the earlier Minister for Railways, stopping of outsourcing and privatisation and recruitment of the wards of the Railway employees,” Mishra said.

AFTER WAITING 30 YEARS, 150 POSTAL STAFF REGULARIZED



Chennai, Mar 9, 2012(TNN): After waiting for 30 years, close to 150 employees of the postal department will finally become regular employees, thanks to the interventionof the Central Administrative Tribunal ( CAT). A bench of G Shanthappa, judicial member and R Satapathy, administrative member, passed orders on the matter.

The applicants were appointed mazdoors with the department of posts in 1982. While joining, they were assured that their services would be regularised. Based on directions in a Supreme Court judgment, the department introduced a scheme in 1991 which stipulated that all casual labourers who worked for eight hours a day for 240 days every year as on November 29, 1989 would be conferred temporary status. 
Those who were granted temporary status and had worked for three consecutive years would be conferred with ‘Group D’ status. These employees – who are now called multi-tasking staff – would be eligible for pension and other service benefits. 

When they approached the tribunal in 2010, they were directed to make individual representations to authorities by listing out their grievances. But their claims were rejected mainly on two grounds – that they were overage and that they did not have the qualification. 
When their fresh applications came up for hearing, M Ravindran, additional solicitor general who appeared for the Union government, said authorities did not have any objection to regularise their services. 
The bench said there “cannot be any hindrance for the absorption of applicants” who have been working for so long. “It has also come to our notice that there are enough vacancies to accommodate the applicants before us,” the bench said. 
Authorities were directed to consider regularising these applicants and give age relaxation and training for those who did not possess matriculation skills within three months.

Sub: Revision of interest rates for small savings schemes.
The undersigned is directed to refer to Ministry of Finance's O.M. of even number dated 11th November, 2011, vide which the various decisions taken by the Government on the recommendations of the Shyamala Gopinath Committee for Comprehensive Review of National Small Savings Fund (NSSF), were communicated to all concerned.
2. One of the decisions of the Government based on the recommendations of the Committee relates to revision of interest rates every financial year, to be notified before 1st April of that year. Accordingly, the rates of interest on various small savings schemes for the financial year 2012-13 effective from 1.4.2012, on the basis of the interest compounding/payment built-in the schemes, shall be as under:

Secretary Generals of FNPO & NFPE met Secretary(P) along with general Secretaries Of PIII,RIV (affiliated with NFPE) and discussed following

  1. Issues arising out of implementation of L1, L2 concept in RMS: Secretary agreed to hold a meeting with Secretary general and General Secretaries of RMS union shortly.
  2. Undue delay In settlement of agreed items on charter of Demands: Secretary agreed to give a details of the follow up action on the charter of Demands
  3. Revision of wages to casual laborers and absorption: Secretary agreed to consider this issue as early as possible.
  4. A memorandum submitted to secretary on the above subjects by the federations will be posted in our web shortly.
  5. Results of IPO Examinations: Probably Department will declare the results on Monday Evening.



Government has formulated comprehesive working plan for the development , expansion and modernization of postal services. The proposed finical allocation for the XII Five year plan, in this regard is

Rs 12,000 crore.
