HC says long leave with proof OK


New Delhi, May 14, 2012(HT): The Delhi High Court has ruled that if an employee remains absent for long owing to medical emergency in the family, resultant domestic problems and submits proof of it, he cannot be dismissed for taking ‘unauthorised’ or ‘excessive’ leave.
“Once the enquiry officer was satisfied that the delinquent employee had taken leave, though excessive, for the sickness of his wife and that medical documents had also been given by him, the enquiry officer had no business to say the workman was guilty of availing excessive leave,”Justice PK Bhasin ruled.
He also said the authority could not punish the employee for unauthorised absence.
The court said this while dismissing an appeal by Delhi TransportCorporation (DTC) against a Delhi Industrial Tribunal order asking it to reinstate driver Anil Kumar, who was dismissed in September 22, 1992, for“unauthorised absence” from duty for 147 days.

The tribunal had asked DTC to reappoint him with full back wages and service seniority. DTC contended that Kumar was dismissed after a proper probe by its inquiry officer.
The tribunal had noted that Kumar had submitted medical certificates of his wife’s treatment at LNJP Hospital from March 1990 to December 1990 and May 1991 to June 1991.
It had also taken into consideration the fact that Kumar said there was nobody except his wife and himself to look after their children. And the resultant domestic problems, which forced Kumar to take leave, and had wondered how the inquiry officer could give an order against Kumar.
The tribunal noted: “There are domestic problems and it cannot be said that the workman availed the leave for no reasons, showing lack of interest in his official duties. Even the findings of the enquiry officer are not to the effect that the conduct of the workman show that he has lack of interest in the duties of corporation.”

ANNOUNCEMENT OF VACANCIES FOR PS GROUP B EXAMINATION


The PS Group B Examination is scheduled to be held on 03.06.2012. But the vacancies for the Examination is yet to be notified by the Directorate. Department has taken decision to conduct PS Group ‘B’ exam on 3rd June, may be under old recruitment rules only. As per the calculations made by the IP/ASP association of Punjab circle, Vacancies predicted for the PS Group BExamination under each category as per existing recruitment rules are around 19 for IP Line in 165 point roster and 2 for General line in 52 point roster.

MATERNITY BENEFIT ACT, 1961



Review and amendments of various labour laws is an ongoing process. TheMaternity Benefit Act, 1961 was amended in 2008 by which for section 8, the following section was substituted: 

“8(1) Every woman entitled to maternity benefit under this Act shall also be entitled to receive from her employer a medical bonus of one thousand rupees, if no pre-natal confinement and post-natal care is provided for by the employer free of charge. 



(2) The Central Government may before every three years by notification in the Official Gazette increase the amount of medical bonus subject to the maximum of twenty thousand rupees”. 

The Central Government vide notification No. S.O. 2016(E) dated 11th August, 2008 increased the amount of medical bonus from Rs. 1000/- to Rs. 2500/-. Further, videnotification No. S.O. 2016(E) dated 19th December, 2011, the amount of medical bonus has been increased from Rs. 2500/- to Rs. 3500/-.

This information was given by the Union Labour & Employment Minister Shri Mallikarjun Kharge in reply to a written question in the Lok Sabha

Vardhanti of Com. Ch.Sambasiva Rao

The 4th  Vardhanti sabha of Late Com. Chinta Sambasiva Rao, Our beloved leader held at Arundelpet HO on 6-05-'12 at Arundelpet HO under the presidentship of Com. M. Sree Rama Murthy, Postmaster, Guntur HO.

platform ticket would be Rs. 5 instead of Rs. 3, a senior railway ministry official said. The increased rate of platform tickets will be charged on tickets issued from May 1. A platform ticket is valid for two hours.
Proposals to increase train fares across the board along with platform ticket were announced by the then railway minister Dinesh Trivedi in the budget.
Trivedi was sacked by Trinamool chief Mamata Banerjee for proposing hike in train fares and subsequently, new railway minister Mukul Roy rolled back the hike proposal barring higher classes.
Increase in platform ticket price was, however, not rolled back.
Railways have given instruction to all zonal railways to print the revised tickets on top priority basis and ensure supply to all stations well in time.
Till that time, old stock of tickets may be used with rate corrected with stamp, said a circular issued by the commercial department of railways.
Railways have also given instructions for the modification in software for issuing platform ticket with new rate through ticket vending machines at stations.

DEPARTMENT CALLED EOI TO CREATE POST BANK OF INDIA

Postal department invited Expression of Interest from the Bidders to submit detailed Project report to Create Post Bank Of India. The last date for submitting the applications are 24/05/2012 and the bids will be opened on 25/05/2012. In the tender document it is clearly mentioned the objectives for setting up the Post Bank Of India are as follows:
(i) Provide banking which means the accepting, for  the purpose of lending or investment, of deposit of money from the public, repayable on demand or otherwise, and withdrawal by Cheque, draft, order or otherwise. PBI will be engaged in various types of banking as mentioned in Section 6 of the Banking Regulation Act, 1949.
(ii)  Provide banking services with special focus on  rural areas.
(iii) Provide means of additional revenue generation for the DoP .
(iv) Ride on the Core Banking Solution which is proposed to be provided in all the post offices.
(v)  Provide a platform for financial inclusion.
(vi) Provide higher order value added services to over 250 Million existing Post Office Savings Bank account holders.
